The Termination, Release and Consulting Agreement between WizKids, Inc. (and its parent The Topps Company) and former WizKids CEO Jordan Weisman, which was filed recently, includes a very interesting passage concerning a 'Star Wars Constructible Strategy Game'... 'already developed' by Weisman.  According to the agreement, if WizKids decides to launch the game, which it 'has pitched to various customers,' Weisman will receive a 2% royalty of net sales that will be capped at $300,000.

 

The royalty rate for the Star Wars CSG, which was developed by Weisman while he was still the WizKids CEO, is lower than the rate he will receive for games he creates as a consultant.  WizKids/Topps has a right of first refusal on all of Weisman's non-electronic game creations, and he will receive a royalty of 5% of net sales for all games based on original intellectual property and a 3% royalty for those created in connection with a third party license.  Weisman recently stepped down as CEO of WizKids in order to concentrate his full energies on creating games (see 'New CEO at WizKids').
